City settles roundabout case with owners




The Spokane Valley City Council authorized the city manager Tuesday to settle a pair of lawsuits from the owners of the Montgomery Court Apartments over a nearby roundabout for $40,000.
According to Cary Driskell, city attorney, the issue – dating back to 2007 just before the roundabout was constructed at the intersection of Wilbur Road, Montgomery Drive and Mansfield Avenue – went to mediation last week.
The monetary settlement finalizes the case, which originated when it was discovered the roundabout’s layout would not allow for eastbound travelers on Montgomery to head north on Wilbur to access the apartment complex.
The owners of the complex – Jon and Mary Gibson along with Wesley and Jeanna Hill – then sued the city, saying that removing the access was an illegal condemnation and a taking of property. While a Spokane County Superior Court judge ruled in 2013 that wasn’t the case, there was no resolution to the owners’ claim the city had promised to build a new entrance on Montgomery.
